Non Declaration and Material Facts
Before signing proposal form for insurance or giving a declaration to underwriters, you must ensure that you have provided any information which could affect their decision to accept the risk or rating of the premium.
Any information which is misleading or untrue, insurers will be entitled to:
a) Void the policy from inception
b) Repudiate any claim arising during the period of insurance
For example, Non disclosure of previous companies liquidation or receivership, previous criminal convictions or any information that could be considered pertinent to the insurer accepting or rating the risk.
Your insurance broker should advise of these potential pitfalls and explain the consequences fully.
